1. Acceptance of Terms
By engaging LTJ Digital (Pty) Ltd, the client agrees to these Terms & Conditions in full.
2. Deposits & Payment Terms
- All work requires a minimum 70% upfront, non-refundable deposit
- The remaining 30% balance is payable upon project completion
- Once LTJ Digital confirms that work is complete, the outstanding balance must be paid within 48 hours
- Failure to pay within 48 hours may result in penalties, suspension of services, or withholding of deliverables
3. Client Delays & Project Stalling
- Projects are dependent on timely client feedback and information
- If a client delays a project by failing to provide required content, approvals, or feedback for extended periods (weeks or months), LTJ Digital reserves the right to:
- Issue the final invoice in full
- Pause work until payment is settled
- Resume work once required information is provided
Delays caused by the client do not delay payment obligations.
4. Non-Refundable Deposits
- All deposits are strictly non-refundable
- Deposits secure time, resources, planning, and intellectual property creation
- No refunds will be issued for cancelled, delayed, or abandoned projects
5. Revisions
- All services include limited revisions
- Excessive changes, scope creep, or rework beyond the agreed scope may incur additional charges
- Final discretion on revision limits rests with LTJ Digital
6. Late Payments & Suspension
- Any missed payment allows a 7-day grace period
- If payment is not received within 7 days:
- Websites, hosting, or services may be suspended or switched off
- Access may be restricted until all outstanding amounts are settled
- LTJ Digital is not liable for losses arising from service suspension due to non-payment
7. Rent-to-Buy Websites (Specific Clause)
For Rent-to-Buy website agreements:
- Ownership remains with LTJ Digital until all payments are completed
- Missed or late payments may result in temporary or permanent suspension
- No refunds are provided for payments already made
- Failure to complete the agreement may result in termination without transfer of ownership
- Sites remain hosted and controlled by LTJ Digital until the contract is fulfilled
8. Intellectual Property
- All intellectual property remains the property of LTJ Digital until full payment is received
- Upon full payment, rights are transferred as agreed, excluding portfolio and marketing usage rights
9. Portfolio & Marketing Use
LTJ Digital may showcase completed work for marketing and portfolio purposes without naming the client unless otherwise agreed in writing.
10. Limitation of Liability
LTJ Digital shall not be liable for indirect, incidental, or consequential damages arising from service use, delays, or suspension due to non-payment.
11. Governing Law
These Terms & Conditions are governed by the laws of the Republic of South Africa.
